2010 UCR fees still haven’t been determined
It may be spring before the 2010 United Carrier Registration program fees are set. Bob Pitcher at the American Trucking Associations wrote in his most recent State Laws Newsletter that roadside enforcement should not be issuing any citations for nonpayment since the fees have not yet been finalized. He also noted that states may not impose any fees connected with the renewal of intrastate operating authority if you hold both intrastate and interstate authority. “Such fees are preempted by federal law for carriers that hold dual authority,” Pitcher writes, “and the preemption does not depend on a carrier’s payment of UCRA fees or registration under that program.”
As proposed in a Federal Motor Carrier Safety Administration rulemaking in September, the fees would be 122% more than what you paid in 2009 on a per-vehicle basis. Part of the increase is to cover a shortfall that is the result of some participating states not adequately enforcing the program’s requirements. No big surprise that FMCSA received mostly negative comments on the proposal.
